Terms and Conditions

Terms and Conditions of LiveFree with T1D

Effective Date: 10/21/2026

1. Agreement to These Terms

These Terms and Conditions ("Terms") are an agreement between you and Mark Heyman Psychologist, Inc., doing business as LiveFree with T1D ("LiveFree," "we," "us," or "our"). They apply when you visit www.livefreewitht1d.com, sign up for free content, join our online community, or purchase any of our programs (together, the "Services").

By using the Services or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Please read Section 19 carefully. It requires most disputes to be resolved through individual binding arbitration and waives your right to participate in a class action.

2. Nature of Our Services

LiveFree provides coaching, education, and peer community for people living with Type 1 diabetes. Our Services are not healthcare. Specifically:

  • Our Services are not medical care, psychotherapy, mental health treatment, or diabetes management advice from a healthcare provider.
  • Using our Services does not create a provider–patient or therapist–client relationship with anyone at LiveFree, including Mark Heyman, PhD, even though he is a licensed psychologist.
  • Our coaches do not diagnose conditions, prescribe treatment, or tell you how to adjust insulin, medications, or devices.
  • You should keep working with your own healthcare team. Do not change your insulin dosing, medications, devices, or treatment plan based on our Services without talking to your healthcare provider.

Mark Heyman Psychologist, Inc. also operates a separate clinical psychology practice. Clinical services are provided only under a separate agreement and are not part of the Services covered by these Terms.

3. Emergencies

Our Services are not designed for emergencies or crisis support, and our coaches do not monitor messages or community posts around the clock.

  • If you are experiencing a medical emergency, including severe low or high blood sugar, call 911 or go to the nearest emergency room.
  • If you are in emotional crisis or having thoughts of harming yourself, call or text 988 (Suicide and Crisis Lifeline in the U.S.) or call 911.

4. Eligibility

You must be at least 18 years old to purchase or participate in our programs or join our community. By using the Services, you confirm that you meet this requirement.

5. Accounts and Access

  • Some Services require an account, such as our online community or course platform. You agree to provide accurate information and keep it up to date.
  • Your access is personal to you. Do not share your login, program materials, or call links with anyone else.
  • You are responsible for activity that happens under your account.

6. Our Programs

Group Coaching

Group coaching programs, including the LiveFree Accelerator, include the live calls, materials, and community access described on the program's sales page at the time of purchase. Group calls take place on the dates and times we publish. If you miss a live call, you may have access to a recording where one is available, but missed calls are not refunded or rescheduled.

1:1 Coaching

1:1 coaching includes the number of sessions and length of access described at the time of purchase. Sessions may be delivered by Mark Heyman or by a LiveFree coach, as stated in the program description. To reschedule a session, give at least 24 hours' notice. Sessions missed or cancelled with less than 24 hours' notice may be counted as used. Unused sessions expire at the end of the program term unless we agree otherwise in writing.

Online Community

Our online community is hosted on a third-party platform (currently Skool). Your use of that platform is also subject to its own terms. Community access may be included with a program or offered as a separate membership.

Free Content and Workshops

We offer free workshops, quizzes, videos, emails, and other content for educational purposes only. Free content does not include individual coaching, and quiz or assessment results are not a diagnosis or professional evaluation.

Changes to Programs

We may update program content, schedules, platforms, or coaches from time to time. If we make a change that materially reduces what you paid for, we will offer you a reasonable alternative or a prorated refund for the affected portion.

7. Payments

Prices are listed in U.S. dollars and are due at the time of purchase unless you choose a payment plan. Payments are processed by third-party payment processors, such as Stripe and PayPal.

One-Time Payments

When you pay in full, you are charged once for the full program price.

Payment Plans

  • A payment plan is a way to pay the full program price in installments. It is not a monthly subscription.
  • By choosing a payment plan, you authorize us to charge your payment method on the scheduled dates until the full price is paid.
  • You are responsible for the full program price even if you stop attending, stop using the program, or ask to cancel, except as provided in Section 8 (Refunds).
  • If a payment fails and is not resolved within 7 days, we may pause your access until your account is current.

Recurring Subscriptions

  • Some Services, such as community memberships, are billed on a recurring basis (for example, monthly) until you cancel.
  • By subscribing, you authorize us to charge your payment method at the start of each billing period at the price shown at sign-up.
  • You can cancel at any time by emailing [email protected] or through your account settings where available. Cancellation takes effect at the end of the current billing period, and you keep access until then.
  • We do not provide refunds or credits for partial billing periods.
  • If we change the price of a subscription, we will notify you at least 30 days before the change takes effect, and you may cancel before then.

8. Refunds

  • Coaching programs (group and 1:1): You may request a full refund within 14 days of purchase, as long as you have attended no more than one live coaching call or session. After that, all payments are non-refundable, and any remaining payment plan balance is still owed.
  • Subscriptions: Subscription payments are non-refundable. You may cancel at any time to stop future charges, as described in Section 7.
  • How to request a refund: Email [email protected] from the email address used for your purchase. Approved refunds are returned to the original payment method.

Filing a chargeback or payment dispute instead of contacting us first may result in loss of access to the Services while the dispute is reviewed.

9. Recordings

  • Group calls may be recorded and shared with members of that program. If you do not want to appear in a recording, you may turn off your camera, use a first name or initials, and use chat instead of speaking.
  • 1:1 sessions may be recorded and transcribed to support your coaching. We notify participants before recording begins. If you prefer that a session not be recorded, tell your coach before or at the start of the session.
  • You may not record, screenshot, or share any call or other participants' information without the written consent of LiveFree and everyone involved.
  • We handle recordings as described in our Privacy Policy.

10. Community Guidelines

Our group programs and community work because members can be honest about life with T1D. When participating, you agree to:

  • Treat other members with respect. No harassment, shaming, hate speech, or personal attacks.
  • Keep what other members share confidential. Do not share their names, stories, health information, or screenshots outside the group.
  • Share your own experience, not medical instructions. Do not tell other members how to dose insulin, change medications, or adjust devices.
  • Not sell, promote, or recruit for other products, services, or programs without our permission.
  • Not post content that is illegal, misleading, or infringes someone else's rights.

We may remove content or remove members who violate these guidelines. We cannot guarantee that every member will follow them, and we are not responsible for what other members say or do.

11. Your Content

  • You keep ownership of anything you post or submit, such as community posts, comments, and form responses ("Your Content").
  • You give us a limited license to host, display, and use Your Content as needed to operate the Services.
  • We will not use your name, photo, story, or results in our marketing, including as a testimonial, without your permission.

12. Our Intellectual Property

All program materials, including videos, worksheets, frameworks (including the LiveFree Operating System), workshops, emails, and website content, are owned by LiveFree or its licensors and are protected by copyright and other laws.

We grant you a personal, non-transferable, non-exclusive license to use these materials for your own personal use while you have access. You may not copy, resell, distribute, teach, publish, or create courses or products from our materials without our written permission.

13. Text Messages

If you opt in to text messages from LiveFree, you agree to receive recurring messages about our programs, events, reminders, and offers at the number you provided. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

  • Reply STOP to stop receiving messages.
  • Reply HELP for help, or contact [email protected].

Carriers are not liable for delayed or undelivered messages.

14. No Guaranteed Results

Coaching outcomes depend on many factors, including your own effort and circumstances. Testimonials and examples reflect individual experiences and are not typical or guaranteed. We do not promise any specific result, including changes to your blood sugar, A1C, emotional wellbeing, or quality of life.

15. Third-Party Services and Partner Content

The Services rely on third-party tools such as Zoom, Skool, and payment processors, and may link to or feature information from partner organizations, including companies in the diabetes field. We are not responsible for third-party services, products, or content, and your use of them is subject to their own terms. Featuring a partner does not mean we endorse a particular product for your individual situation; talk to your healthcare provider before making device or treatment decisions.

16. Disclaimer of Warranties

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or available at all times.

17. Limitation of Liability

To the fullest extent permitted by law, LiveFree and its owners, employees, coaches, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any health decisions you make, arising from your use of the Services.

Our total liability for any claim related to the Services is limited to the amount you paid us in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Termination

  • You may stop using the Services at any time. Payment obligations for payment plans continue as described in Section 7.
  • We may suspend or end your access if you violate these Terms, including the Community Guidelines, or fail to pay. If we end your access for a violation, you are not entitled to a refund.
  • If we end your access for reasons unrelated to a violation or non-payment, we will provide a prorated refund for the unused portion of your program.

19. Dispute Resolution and Arbitration

Informal Resolution First

Before starting any formal proceeding, you agree to contact us at [email protected] with a description of the issue. We will try to resolve it informally within 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, you and LiveFree agree that any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in San Diego County, California, or by video or phone if both parties agree.

Exceptions

  • Either party may bring an individual claim in small claims court if it qualifies.
  • Either party may seek court relief to protect intellectual property rights.

Class Action Waiver

You and LiveFree agree that claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding.

Right to Opt Out

You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

20. Indemnification

You agree to indemnify and hold harmless LiveFree and its owners, employees, coaches, and contractors from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Services.

21. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to Section 19, any court proceedings will take place in the state or federal courts located in San Diego County, California.

22. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on our website with a new effective date, and for significant changes we will notify you by email or a website notice. Changes do not apply retroactively to purchases made before the effective date. Continuing to use the Services after changes take effect means you accept the updated Terms.

23. General

  • These Terms, together with our Privacy Policy and any program-specific terms shown at purchase, are the entire agreement between you and LiveFree regarding the Services.
  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
  • You may not transfer your rights under these Terms. We may transfer ours in connection with a sale or reorganization of our business.

24. Contact Us

If you have any questions about these Terms, contact us at [email protected] or +1 858-465-4235.
